Terms of Service

This agreement

These Terms are an agreement between you and Domavant Holdings LLC ("we", "us"), which operates Sunday Squares at sundaysquares.org (the "Service"). By creating an account or using the Service, you accept these Terms. If you are accepting on behalf of an organization, you confirm you are authorized to bind it.

Our Privacy Policy is part of this agreement.

What the Service is — and what it is not

Sunday Squares helps a nonprofit organization run a football raffle. It generates numbered tickets to print, records who bought each one, runs a random drawing you can independently check, follows the game scores, and works out which ticket won each drawing.

The Service is not the raffle. Specifically:

• The organization conducts the raffle under its own authority and its own state registration.
• Tickets are sold in person by the organization's volunteers. There is no ticket sale through this site.
• The organization collects and holds all money. No funds pass through Sunday Squares.
• Prizes are provided and awarded by the organization. Any claim to a prize is against the organization, not against us.
• We are not a party to the transaction between an organization and its ticket buyers.

We do not operate a lottery, take entries, hold stakes, or set or accept anything of value on the outcome of a game. The Service records what an organization does.

Eligibility

You must be at least 18 years old to create an account. You must provide accurate information and keep your sign-in details secure. You are responsible for what happens under your account.

If you run raffles: your responsibilities

Charitable raffle law is state-specific and it is yours to satisfy. By running a raffle through the Service you agree that:

• You are solely responsible for determining whether your raffle is lawful where you operate, and for obtaining any registration, licence or permit it requires before selling a ticket.
• You will file whatever reports your state requires. The Service can prepare figures and pre-fill certain forms from your own records, but the figures, the answers to any certification, and the signature are yours.
• You will award the prizes you advertised, and you accept that the obligation to do so is yours alone.
• You will apply the proceeds as your state's rules require, and as you told your ticket buyers you would.
• You will keep the buyer information you record accurate, use it only to run your raffle and to reach your own buyers, and not sell it or use it for unrelated marketing.
• You will not use the Service to run an activity that is not permitted where you operate, or to sell tickets in a manner your state prohibits.

Anything the Service shows you about state rules is general information compiled for convenience. It is not legal advice, it may be out of date, and it is never a determination that your raffle is lawful. Take advice from your own counsel.

If you hold a ticket

Your ticket was issued by the organization that sold it to you. Sunday Squares shows you the ticket, the drawing and the result, so that you can check them yourself.

• Questions about payment, a mistake on your ticket, or receiving a prize go to your organizer. Their contact details are on the ticket and on the raffle page.
• A printed ticket code works like a key: whoever enters it first ties that ticket to their account. Keep it to yourself, and tell your organizer promptly if a ticket goes missing.
• Results shown during a game are provisional until the game is official and the organization confirms them.

Fees

The Service is currently provided to organizations free of charge, and we take no share of ticket sales. If we introduce a fee, we will give notice before it applies to you, and you will be free to stop using the Service instead.

Acceptable use

You agree not to:

• Use the Service for any unlawful purpose, or to promote an activity that is unlawful where it takes place.
• Access records belonging to another organization or another person, or try to defeat the access controls that separate them.
• Probe, scan, overload or interfere with the Service or the infrastructure it runs on.
• Misrepresent an organization's tax-exempt status, or the destination of raffle proceeds.
• Impersonate another person, or use the Service to harass ticket buyers or volunteers.
• Scrape or bulk-extract personal information from the Service.

Intellectual property

The Service, its software, design and content are ours or our licensors', and these Terms grant you a limited, revocable, non-transferable right to use the Service — nothing more.

Everything you put into the Service — your organization's name, logo, mission and raffle records — stays yours. You give us the permission we need to host and display it in order to run the Service for you, including on the public raffle pages you choose to publish.

Sunday Squares is not affiliated with, endorsed by, or sponsored by the National Football League or any team.

Third-party data and services

Game scores come from third-party feeds. They can be delayed, incomplete or wrong, and we do not guarantee them. Where a result matters, the organizer's own entry of the official score is what governs. Nonprofit status shown from a public IRS-derived database is likewise informational, and it is the organization's own responsibility to represent its status correctly.

Disclaimers

The Service is provided “as is” and “as available”. To the fullest extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any result, score or figure it displays is accurate.

We give no legal, tax or accounting advice. Nothing in the Service is a determination that your raffle is lawful, that a contribution is tax-deductible, or that a filing is complete.

Limitation of liability

To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost revenue, lost data, or the cost of substitute services.

Our total liability arising out of or relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim, or one hundred US dollars. Because the Service is currently free, you should read that as one hundred dollars.

Nothing here limits liability that cannot be limited by law, including for fraud or for death or personal injury caused by negligence. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.

Indemnification

If you run raffles through the Service, you agree to indemnify and hold us harmless from any claim, loss or expense (including reasonable legal fees) arising out of your raffle — including your compliance with charitable gaming rules, your handling of proceeds, the prizes you award, and your use of the information you collect about your ticket buyers.

Suspension and termination

You may stop using the Service and delete your account at any time from your Profile page. We may suspend or end access where these Terms are breached, where required by law, or where continuing would expose us or an organization's ticket buyers to harm — and we will give notice where we reasonably can. Organizations can export their records before leaving.

Changes to these Terms

We may update these Terms. The date at the top will change, and for material changes we will notify account holders by email before they take effect. Continuing to use the Service after that means you accept the new Terms.

Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. You and we agree to the exclusive jurisdiction of the state and federal courts located in California for any dispute arising out of or relating to the Service or these Terms.

Before filing anything, please write to us — nearly everything is faster to fix by email than by litigation.

Miscellaneous

These Terms and the Privacy Policy are the entire agreement between us about the Service. If a provision is held unenforceable, the rest stands. Our not enforcing a provision is not a waiver of it. You may not assign this agreement without our consent; we may assign it to a successor in connection with a merger or sale of the business.
